Terms and Conditions of Service - 3DLab
These Terms and Conditions govern access to and use of the shop3dlab.it website, as well as the purchase of products sold through the website.
The website is operated by 3DLab. The seller's identification and contact details are indicated on the "Legal Notice" page and/or on the "Contact Information" page of the website.
By accessing the website, using the services or placing an order, the user declares that they have read, understood and accepted these Terms and Conditions, the Privacy Policy, the Return and Refund Policy and the other policies published on the website.
1. Definitions
For the purposes of these Terms and Conditions:
- 3DLab: the seller and operator of the shop3dlab.it website.
- Website: the shop3dlab.it website and its pages, functions, content and services.
- Customer: the person who purchases one or more products through the website.
- Consumer: the natural person who purchases for purposes unrelated to any business, commercial, craft or professional activity carried out.
- Professional or business customer: the person who purchases within the scope of their business, commercial, craft or professional activity.
- Products: accessories, aftermarket components, configured, customized or made-to-order items and other items sold through the website.
- Online configurator: the tool that allows the customer to select features, compatibility, colors, variants, text, logos, models or other product specifications before purchase.
2. Subject of the service
3DLab manufactures and sells aftermarket motorcycle accessories and components, including products that can be configured online and produced at the customer's request.
3DLab products are not original products of motorcycle manufacturers and must not be understood as original spare parts, unless expressly indicated otherwise.
The names of brands, models and motorcycle manufacturers that may appear on the website are used exclusively to indicate product compatibility. 3DLab is an independent business and is not affiliated with, sponsored by, authorized by or approved by the brands mentioned, unless expressly and documented otherwise.
3. Use of the website
The user undertakes to use the website exclusively for lawful purposes and in compliance with applicable law, these Terms and Conditions and the rights of 3DLab and third parties.
By way of example, it is prohibited to:
- use the website for unlawful, fraudulent or unauthorized activities;
- provide false, incomplete, inaccurate data or data belonging to third parties without authorization;
- violate intellectual, industrial or commercial property rights of 3DLab or third parties;
- copy, extract, reproduce, modify or reuse content, images, renders, descriptions, files, graphics, designs or elements of the website without written authorization;
- interfere with the operation of the website, attempt unauthorized access or use automated scraping, crawling or data extraction tools;
- use the website or the products for purposes incompatible with their nature, intended use or description.
The user is responsible for the accuracy, completeness and truthfulness of the data provided during browsing, configuration and purchase.
4. Intellectual property
All content on the website, including by way of example images, renders, photographs, texts, descriptions, graphics, logos, configurations, designs, models, 3D files, technical solutions, layouts, visual elements and products, is owned by 3DLab or the respective rights holders and is protected by current intellectual and industrial property law.
Any copying, reproduction, distribution, modification, publication, resale, reverse engineering, imitation, extraction or use, even partial, of 3DLab content and designs without prior written authorization is prohibited.
It is also prohibited to use 3DLab images, renders, descriptions, files, designs or configurations to create, have created, promote or sell identical, similar or derivative products.
Any violation may be pursued before the competent authorities, with requests for cessation of the unlawful conduct, removal of content, compensation for damages and reimbursement of expenses incurred, within the limits provided by law.
5. Product information
3DLab undertakes to describe the products as accurately as possible. However, images, renders, photographs, colors, proportions and graphic representations are for illustrative purposes and may differ from the final product.
Products may have slight aesthetic, dimensional, color or surface variations due to the production process, the chosen configuration, the production batch, material performance, the customer's screen settings or technical updates.
Such variations, if they do not substantially affect the functionality and conformity of the product with respect to the order, do not constitute a defect or non-conformity.
3DLab reserves the right to make technical, aesthetic or production changes to the products, provided that the nature of the purchased product is not substantially altered.
6. Online configurator and customized products
Products purchased through the online configurator, accessible from the "Customize yours now" button or similar wording, are configured or manufactured based on the specifications selected by the customer.
The specifications may include, by way of example, compatibility, colors, aesthetic combinations, variants, text, logos, graphics, measurements, adaptations or other features requested by the customer.
The customer is responsible for the accuracy of the information entered in the configurator or communicated to 3DLab, including model, year, measurements, compatibility, aesthetic preferences and technical instructions.
Before confirming the order, the customer is required to carefully check all selected specifications. Errors, omissions or inaccurate information provided by the customer may result in incompatibility or in the creation of a product unsuitable for their needs.
When a product is made, modified or configured according to specifications chosen by the customer, it may be considered a good made to measure or clearly customized pursuant to Article 59 of Italian Legislative Decree 206/2005.
7. Product compatibility
The compatibility information on the website is based on the information available to 3DLab at the time of publication.
Since motorcycles, components and accessories may vary depending on year, version, previous modifications, trim, production tolerances or work carried out by the owner, the customer is required to carefully verify compatibility before purchase.
In case of doubt, the customer is invited to contact 3DLab before ordering, providing photos, measurements and complete information about the vehicle or the component concerned.
3DLab is not responsible for incompatibility resulting from incorrect, incomplete or unverified data provided by the customer, vehicle modifications, non-original components or non-compliant installations.
8. Intended use and warnings
Unless expressly indicated otherwise on the product page, 3DLab products are aftermarket accessories intended for sport, track, display, aesthetic or amateur use.
The products are not certified safety devices and do not guarantee the prevention of damage to the motorcycle, the rider, third parties or property.
The products are not approved for use on public roads, unless expressly and documented otherwise. Any use on public roads is under the customer's sole responsibility; the customer is required to check in advance the product's compliance with the applicable regulations in the place of use.
The customer acknowledges that the use of aftermarket accessories on vehicles may involve technical, mechanical, aesthetic or functional risks and undertakes to use the products with prudence, awareness and in compliance with applicable law.
9. Materials, technical limits and conditions of use
3DLab products are made with technical materials suitable for the intended use indicated on the product page, but remain subject to physical, mechanical, thermal and chemical limits.
Heat, vibrations, impacts, falls, rubbing, fuels, oils, solvents, aggressive detergents, chemical agents, prolonged sun exposure, intensive use or extreme conditions may cause wear, deformation, aesthetic changes, breakage or deterioration of the product.
The customer is required to avoid exposing the product to conditions incompatible with its nature and to stop using it in the event of damage, deformation, abnormal wear or doubt about its integrity.
Any technical, thermal or use limits indicated by 3DLab are to be considered indicative values and do not constitute a performance guarantee in every condition of use.
10. Installation and maintenance
Installation of the products is at the customer's expense and under the customer's responsibility, unless otherwise agreed in writing.
The customer must check before, during and after installation that the product is compatible, intact, correctly fastened and does not interfere with mechanical parts, moving parts, brakes, wheels, transmission, steering, suspension or other essential vehicle elements.
It is the customer's responsibility to use suitable tools, follow any instructions provided by 3DLab and, if necessary, contact competent or qualified personnel.
3DLab is not responsible for damage, malfunction, incompatibility, breakage or accidents resulting from incorrect installation, improper use, incorrect fastening, insufficient maintenance, unauthorized modifications or non-compliant use.
Before each use of the vehicle, the customer must check the condition of the product, tightness, integrity, absence of cracks, deformation, wear or interference.
11. Orders and conclusion of the contract
The submission of an order by the customer constitutes a purchase proposal for the selected products.
The contract is considered concluded when 3DLab confirms the order or starts order management, except in the event of obvious errors, unavailability, technical anomalies or other causes preventing execution.
3DLab reserves the right, within the limits permitted by law, to refuse, cancel or suspend orders in the event of:
- incomplete, incorrect, false or unverifiable data;
- unauthorized, incomplete or suspicious payment;
- obvious errors in price, description, availability or configuration;
- technical or production impossibility of manufacturing the product;
- requests incompatible with the nature of the product or with applicable law;
- abusive, fraudulent conduct or conduct contrary to these Terms and Conditions;
- unavailability of materials, components or tools necessary for production.
In the event of order cancellation after payment, 3DLab will refund any amounts paid, unless otherwise agreed with the customer or in cases provided for by law.
12. Prices, payments and availability
Prices are indicated in euros and include or exclude any taxes as indicated on the website and at checkout.
Any shipping costs, surcharges or additional services are shown before order confirmation, where applicable.
3DLab reserves the right to modify prices, promotions, availability and product features at any time. Changes do not affect orders already confirmed, except in the event of obvious errors or causes not attributable to 3DLab.
Production, configuration or preparation of the order normally begins after receipt of payment.
13. Production and shipping times
3DLab products may be manufactured, configured or prepared after order confirmation. The times indicated on the website are estimates and may vary depending on workload, product complexity, material availability, requested customization and courier service.
3DLab undertakes to manage orders diligently, but is not responsible for delays due to external events, couriers, force majeure, logistics issues, errors in the shipping data provided by the customer or circumstances not reasonably controllable.
For consumers, the risk of loss of or damage to the product passes to the customer when the customer, or a third party designated by the customer other than the carrier, physically takes possession of the product.
If the customer independently chooses a carrier other than those proposed by 3DLab, the risk may pass in accordance with applicable law.
14. Order cancellation
The customer may request cancellation of the order by promptly contacting 3DLab at the email address indicated on the website.
For standard products, cancellation is possible if the order has not yet been prepared or shipped.
For configured, customized or made-to-measure products, cancellation is possible only if the request is received before production, customization, configuration or processing has started.
Once production, customization, configuration or processing of a made-to-measure or clearly customized product has begun, cancellation may no longer be possible, unless otherwise agreed with 3DLab or in cases provided for by law.
15. Right of withdrawal
The right of withdrawal is governed by the Return, Withdrawal, Refund and Warranty Policy published on the website, which forms an integral part of these Terms and Conditions.
For any standard products that are not customized, not configured and not made to the customer's specific request, the consumer may exercise the right of withdrawal within the terms and according to the methods provided for by current law.
Pursuant to Article 59 of Italian Legislative Decree 206/2005, the right of withdrawal is excluded for the supply of goods made to measure or clearly customized.
Therefore, except in the event of a defect, error or non-conformity, withdrawal for simple change of mind does not apply to products configured through the online configurator, customized, made to measure or made according to specifications selected or communicated by the customer.
The exclusion of withdrawal for customized products does not in any way limit the customer's rights in the event of a defective, incorrect or non-conforming product.
16. Legal warranty of conformity
Products sold to consumers are covered by the legal warranty of conformity provided for by the Italian Consumer Code.
The legal warranty applies to lack of conformity existing at the time of delivery of the product and becoming apparent within the time limits provided for by law.
In the presence of a lack of conformity, the consumer has the right to the remedies provided for by current law, according to the conditions and limits established by law.
The warranty does not cover damage or problems caused by improper use, incorrect installation, unauthorized modifications, normal wear and tear, impacts, falls, accidents, exposure to heat, chemicals, fuels, solvents, insufficient maintenance, non-compliant use, installation on modified vehicles or incorrect information provided by the customer.
For the handling of defects, returns, replacements or refunds, the provisions of the Return, Withdrawal, Refund and Warranty Policy published on the website apply.
17. Limitation of liability
To the maximum extent permitted by law, 3DLab is not responsible for direct or indirect damage, economic losses, loss of profit, damage to vehicles, property or third parties resulting from improper use, incorrect installation, non-compliant use, unauthorized modifications, use on public roads, failure to follow instructions or use of the products in conditions incompatible with their nature.
No provision of these Terms and Conditions limits or excludes 3DLab's liability in cases where such limitation or exclusion is not permitted by law, including cases of willful misconduct, gross negligence, personal injury or mandatory rights granted to the consumer.
For professional customers and within the limits permitted by law, 3DLab's total liability for any claim relating to an order may not exceed the amount actually paid by the customer for the order subject to the dispute.
18. Indemnity
Within the limits permitted by law, the customer undertakes to hold harmless and indemnify 3DLab from claims, damages, costs, liabilities, penalties or expenses, including any legal expenses, arising from:
- improper or non-compliant use of the products;
- incorrect or unsafe installation;
- unauthorized modifications, adaptations or work;
- use on public roads without approval or regulatory compliance;
- violation of laws, regulations or third-party rights;
- incorrect data, measurements, compatibility or information provided by the customer;
- violation of these Terms and Conditions.
This clause does not limit the mandatory rights granted to the consumer by applicable law.
19. Reviews, submitted content and customer photographs
If the customer sends 3DLab photographs, videos, reviews, feedback, images of the installed product or other content, the customer declares that they have the right to send them and that such content does not violate third-party rights.
Unless otherwise agreed in writing, voluntary submission of such content authorizes 3DLab to use it for assistance, technical verification, service improvement and, if expressly authorized by the customer, promotional purposes or publication on 3DLab channels.
3DLab reserves the right not to publish, to remove or to moderate reviews and content that are offensive, false, misleading, unlawful, irrelevant or harmful to third-party rights.
20. Links to third-party websites
The website may contain links to websites, platforms, social networks, tools or services operated by third parties. 3DLab is not responsible for the content, terms, privacy policies, security or operation of third-party websites and services.
The use of third-party services is subject to the terms and policies of the respective providers.
21. Privacy and cookies
The processing of users' personal data is governed by the Privacy Policy published on the website.
The use of cookies and tracking tools is governed by the Cookie Policy and by the cookie banner settings, where available.
22. Force majeure
3DLab is not responsible for delays, non-performance or inability to perform its obligations due to force majeure or events not reasonably controllable.
Such events include, by way of example, strikes, transport blocks, natural events, fires, power interruptions, technical problems, unavailability of materials, malfunctioning of third-party platforms, measures by authorities, health emergencies, courier delays or similar events.
23. Changes to the Terms and Conditions
3DLab reserves the right to modify, update or supplement these Terms and Conditions at any time.
Changes will be effective from the date of publication on the website and will apply to orders placed after such publication.
Orders already confirmed are subject to the Terms and Conditions in force at the time of purchase, except for changes imposed by law or more favorable to the customer.
24. Severability
If one or more provisions of these Terms and Conditions are considered invalid, ineffective or unenforceable, the remaining provisions will continue to be valid and effective.
The invalid or ineffective provision will be replaced, within the limits permitted by law, by a valid provision pursuing purposes as similar as possible.
25. Applicable law and competent court
These Terms and Conditions are governed by Italian law.
For consumer customers, the application of the mandatory rules provided for by the law of the consumer's country of residence, where applicable, and the jurisdiction of the court of the consumer's place of residence or domicile in the cases provided for by current law remain unaffected.
For professional or business customers, unless otherwise mandatorily provided by law, the competent court is that of the place where the seller has its registered office.
26. Specific clauses for professional customers
For customers purchasing as professionals, businesses, resellers or business entities, pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, where applicable, the clauses relating to refusal or cancellation of orders, product variations, exclusions and limitations of liability, indemnity, competent court, warranty exclusions for improper use, cancellation of customized orders and changes to the Terms and Conditions are specifically approved.
27. Final acceptance
By placing an order on the website, the customer declares that they have read, understood and accepted these Terms and Conditions, the Return, Withdrawal, Refund and Warranty Policy, the Privacy Policy and the other policies published on the website.
The customer also declares that they have carefully checked compatibility, specifications, intended use, any customization and product features before purchase.
